Through investment, it is possible to Green Card with the EB-5 program. The program was created by the Immigration Act of the United States Congress in 1990. The program aims to encouraging foreign investment in the country in locations considered less privileged.

Growing interest from Brazilians 

According to the US Citizenship and Immigration Service, 388 visas of this type were issued to Brazilians in 2018. This total includes investors and their families, such as spouses and children up to the age of 21. 

According to the agency, the number of Brazilian citizens interested in EB-5 grows every year. In 2017, 282 Brazilians applied for the program. In previous years there were 150 (in 2016), 34 (in 2015) and only 11 (in 2011). Many factors in domestic politics are responsible for the increase in demand to live in the USA. These include the economic crisis and violence. On the other hand, the United States has an effervescent economy and many business opportunities.

Prerequisites for the EB-5 investor visa

In order to enter the EB-5 program, the investor needs to inject risk capital into a for-profit entity in the country. The amount is USD 500,000 in rural areas or places with high unemploymentTargeted Employment Areas. Or USD 1 million in urban areas

It is also possible to set up a new business in the country and comply with the program. The crucial thing is to generate at least 10 direct jobs for a period of five yearsat least. 

In addition, the investor needs to have clean record. In other words, you can't have committed serious crimes, fraud or violated US immigration laws. You must also prove the origin of the investment money (it can be from inheritance, loans, accumulated profits, etc.). 

Change in the value of EB-5

As of November 21 of this year, the investment threshold for TEAs will be USD 900 thousand. For those wishing to start their own business, the minimum will rise from USD 1 million to USD 1.8 million.

Types of EB-5 investment

The types of investments that are viable and authorized for an EB-5 applicant to inject their capital into are places with tourist appeal, such as resorts and hotels, restaurants and even sports stadiums, shopping malls and luxury condominiums. 

  • Loan: in this type of EB-5 loan, the investor deposits their money in the project as a loan. After five years, the person responsible for the project has to pay back the amount invested and the investor still gets a return on the amount with interest of between 0 and 3% per year.   
  • Equity: in the equity model, the investor becomes a partner in the venture with a full share of the profits. This model is riskier, which is why it is not very popular with foreigners. 

How long does the process take? 

Obtaining a residence visa through EB-5 can take between 7 and 24 months. Once approved, the investor and their family group receive a kind of "conditional" green card valid for two years. 

A permanent green card comes after a few years. You also have to bear in mind that there is a limit of 10,000 EB-5 visa approvals per year (for all nationalities).
